What would you do? (What should I do?) UPS - Issue

I am helping a friend re-build his computer. Computer needs/needed to be built/setup ready to go this A.S.A.P. I am headed out of town at the end of the week and he is in need.Anywho, on to the dilemma at hand.

I ordered all of the parts from NewEgg.com (As always). Order was placed Wednesday (7.30.2008) Morning (9AM-ISH).
The estimated delivery was 3 days. I opted to pay for 2-Day air and rush processing.
Everything looked fine until Thursday when the order still had not been picked up. I figured maybe UPS systems were updating still or even down (sh*t happens you know). Well come Thursday evening the package status was updated to be delivered on 8/4/2008. I was a little upset, but understand delays and what not happened. I sent a request on live chat for some assistance. I was trying to gain information if this was a shipping error? or if my Rush processing didn't take. The representative informed me there was a delay with UPS. And would be happy to refund the shipping fees. I don't understand how Newegg can do this, but I am not going to argue with free shipping (even if its a few days late). Well any ways the shipment showed up today. The box was pretty smashed, at first I was not too worried for these things happen. Upon inspeciton however, things were a little out of place.

The mother board box was exposed. The Intel CPU (E8400) box was smashed, to the point that the very fine bit of tape that lies on the Intel seal was peeling off. All the bubbles on one side of the DVD/CD OEM drive were popped.

I really do not have a problem with the motherboard box or the DVD/CD drive. The thing that errks me is the CPU box.

I can physically see the cpu is not smashed but I am unaware of any actual damage that could have been done to the cpu or the heat sink.

I have uploaded the pictures to my web site. Please click on the web link below to view them.

    Thank you

     <--- /EDIT --->

So my question is how should I proceed?

The package was already accepted from UPS (I was not present at the time).
Apart from the box being smashed. The cpu doesn't look to be damaged.

    What would you do?

Take in mind I need to get this thing up and running before I leave.

Thank you in advance for your help and input.

    Kindly,
    Chevymanusa

I would contact one of theses two and see what they say to do.

sj1dog Or Jas0n Both work for NewEgg and are great guys.

Looks like it fell off the back of the truck.......................................... 3 or 4 times Hmm

Those things are packaged very well, they should be fine, I'd be worried about the drive though.

I'd throw it together and see how it goes, and then if it doesn't, contact UPS and New Egg if anything doesn't work. UPS should be held responsible for your Items. If Everything works, I would still contact UPS and file a complaint so they are made aware of the issue.

NE shipping generally runs one strand around the box. Looking at that box, it's got much more tape splashed across it than I've ever seen. Even crisscross, which I've never seen! I would suggest that that box popped open somewhere along the lines of being gorilla'd by UPS, and UPS slammed her back together, with a mickey tape repair, before delivering.

I have a great relationship with my UPS brown shirt, he's great, but even he'll be the first to admit,. TLC is not their best trait.

I would hazard to guess if anything is mushed defective, a claim is in order.

Knowing you don't want to hear those words, follow the advice, the NE CSREPs will TCOB. Best in the world, bar none.

I am sure UPS is majorly at fault here, it’s obvious the package was smashed during travel.
The box/packaging was very insufficient for the abuse this package took. I was a little puzzled and shocked when I saw the mother board box on its side and partially visible while in the box.

I have no idea what happened with the taping issue. Normally the boxes are receive from Newegg our rather good condition. And almost always a times and half the size needed or twice the size of the contents. I was concerned that this doesn’t look like a normal box newegg would send, but I think I am more concerned over the fact that I didn’t receive any flyers or promotional ads in there. I normally get about 4 or 5 duplicate ads in my boxes.

I am not sure on the peanuts. I have received packages from Newegg with those green ones but its been a while since I have seen any. Sometimes I even get static peanuts, not too worried since most of the stuff is boxed up that I ordered. I find it out too that I didn’t see any plastic air bag thingy’s (no idea on the name).

Thanks again for all the replies and comments.

Re: What would you do? (What should I do?) UPS - Issue

If you haven't filed a complaint yet with UPS, do it, even if you plan on persuing your end goal through other means, and even if you're told UPS won't do anything.  If you have it on record that you complained to UPS already and they gave you a certain response, you will be able to more effectively deal with any involved party.  Also, if it did ever come down to taking any kind of legal action, UPS is the one you would have to go after, so it would help in that (though I seriously doubt it would go that far). Also, filing complaints with the better business buearau about UPS will help speed things along with them.  From personally experience shipping companies resist dealing with you as much as possible until you show them you're willing to drag them through the mud over it.

You can try and run the stuff but if anything that is ESD sensitive was exposed, I would not, as something that has suffered ESD can seem to operate fine for a month or more before failing under load at a later date, and both cardboard packaging and styrofoam packing peanuts can throw off a lot of static unless they are the ESD preventing kind, which I have no idea if newegg uses them or not.
