    Bank Error in your favor...

In an article released today on Yahoo News http://news.yahoo.com/s/nm/20080220/us_nm/usa_crime_error_dc;_ylt=AgD6NNcLZ0CsXq7AaTpLbmxvzwcF, a New York man has been charged with grand larceny for withdrawing over $2 million after there had been a bank error which placed more than $5 million into his account.

My question for everyone is....What would you do if you had a bank error like this with your account? I know the logical answer is to say "I would contact the bank to get it fixed" but I have a feeling there are some of you out there that would be in the same boat as this guy. Thinking that you are not going to get caught if you just take out a little bit of it. What would I do?? Well I just hope I am never placed into a situation where I have to make that decisionZip it!

Can I plead the 5th on this, LOL.

They will notice when $5mil is in some ones account guaranteed. Might take a little while but they will figure it out eventually.

Hm... I don't see why he would get charged... it's a bank error. The bank should be eating that loss.

I agree, he even tried to tell them they must have made a mistake and they dis-agreed.  Till they did not then they want him in-jail for their error.  Seems strange way to look at law.

    Yes

    1. accuse the bank for the inducement of commiting a crime

    2. inform the bank and try to get a reward from them.

Re: Bank Error in your favor...

I thought this was hooie.....so.....I read the article....I was right......there was no "bank error", this was a TELLER's error.

He goes there to make a deposit, but when he finds out his balance is, (incorrecly,) 5 mil.....he withdrawls....

This teller surely be cashiered.....it says he made 'multiple' withdrawls.....from the SAME teller I'd bet.

He received NO 5 mil deposit notification, he never told the teller she was looking at the wrong account....

His behavior ALONE should have alerted the teller...."my ballance is WHAT ?  "could you check again ?"   "I'd like to withdrawl $100,000 I won't be neededing that deposit-slip after all."

    LOL

    he hasn't got a prayer.....lol

woo, similar situation did happen in China. The poor man was sentenced to life imprisonment for larceny. Click here for details: http://www.bjreview.com.cn/forum/txt/2008-01/13/content_95580.htm

I never wanna have a chance to make such a decision.

Re: Bank Error in your favor...

Haha. If he notified the bank and they told him go p*ss off then that's not his fault. At least he tried to give it back.
